Utah judge sentences HIV-positive prostitute to 1 year in jail

A Salt Lake City, Utah prostitute who knew she was HIV-positive yet continued plying her trade, was sentenced Monday to 1 year in jail.
Prosecutor Simarjit Gill argued that a 0-to-5-year prison term would better protect society from Teresa Marie Romo, 40.
Romo had pleaded guilty as charged to third-degree felony prostitution with prior knowledge of being HIV positive.
Gill said Romo has racked up 24 sex-related offenses -- six since April 1995, when she was officially notified she was HIV-positive.
Gill claimed "the kindest thing we can do [for Romo]" would be to send her to prison, where she can receive adequate treatment for her HIV-positive condition. Gill said Romo also has hepatitis B, cervical cancer and an addiction to crack cocaine.
But Utah 3rd District Judge Robin Reese ordered the case closed after Romo serves 365 days in jail, with credit for the 3 months she has served since her arrest.


Gill expressed surprise that the judge did not impose probation, which would hold the threat of prison over Romo's head to discourage her from re-offending. The judge told Gill he could file new charges, if that occurs.
Defense attorney Brennon Fuelling had requested Romo be given the opportunity to get out of jail and pursue treatment for her health problems.
Said Romo: "I am asking you to have mercy on me . . . my days are numbered. Prostitution and drugs are the last thing on my mind."
On July 9, 2003, Romo was arrested after Utah vice officers watched her get into a man's pickup truck near 1000 South and State Street.
When the driver was pulled over, Romo was engaged in providing him oral sex, according to charging documents. The driver admitted paying $30 for the sex act. Romo told police she was earning money for rent.
